Parties in a matrimonial dispute have got two options for getting divorce.
The first one is divorce on mutual consent. In this case, both the parties should amicably settle their disputes and both the parties should decide to obtain decree of divorce and after such mutual settlement, both the parties jointly have to apply before the Learned District Judge of the concerned district for a decree of divorce. The learned District Judge, after lapse of minimum six months from the date of filing of the application, will fix up a date for hearing the case and on that day, both the parties, personally have to appear before the Ld. District Judge to depose. After such hearing, if the Ld. Dist. Judge considers it fit to dissolve the marital tie, order to that effect will be passed.
The second option is to file suit for divorce stating the grounds for the same. The other side will be summoned and after hearing both the contestants the Ld. Dist Judge will decide the fate of the application.
Parties in matrimonial disputes may go for judicial separation without seeking for divorce. In this case the marital tie remains intact and the parties are lawfully entitled to remain separate. Sometimes I experienced that after a few days of separation, parties could reconcile their own.
